Terms & Conditions


1. The present terms and conditions are applicable to any transport carried out by “Heytrans”, unless subject to other written provisions; signing the present transport order implies automatic notification and acceptance of these terms & conditions.

2. “Heytrans” will do everything in its power to ensure that the Sender is satisfied, more specifically as regards the delivery terms. It is worth noting, however, that these are only provided under normal traffic conditions and taking into account accidents or cases of force majeure, such as lock-out, social conflicts, comparable circumstances with civil or international
wars, customs issues, heavy weather conditions, technical incidents.

3. “Heytrans” will take out insurance for the transported goods in compliance with Art. 23 of the Contract for the International Carriage of Goods by Road, excluding all other compensation for direct or indirect damage that may result from an event preceding the entering into force of such a guarantee. The Sender is free, prior to every transport, to state, on the front of the shipment note,
the real value of the goods; an additional insurance will then be invoiced on top of the transport costs.

4. Goods packed in crates or in any other packaging will be accepted without prior checks and will be transported without any guarantee regarding their contents, which will be deemed to have been dispatched in the state in which they were delivered to “Heytrans”. “Heytrans” will only transport high-risk goods (jewellery, cash, antiquities, bonds, etc.) under the full responsibility of the
Sender.

5. Every complaint shall be notified by registered receipt mail to “Heytrans” within 5 days of receipt of the goods by the Consignee or within 5 days after the scheduled delivery. Otherwise the complaint shall be deemed invalid.

6. If delivery to the Consignee proves to be impossible due to an error when drawing up the shipment note, due to refusal or absence of the Consignee, the price of a round trip will be invoiced to the Consignee.

7. The transport of dangerous goods is not one of “Heytrans”’s objectives. As a result, only the Sender will be deemed liable for any direct or indirect harmful consequences of such a transport, should the Sender entrust such goods to “Heytrans” without prior notification.

8. All invoices are payable in Brussels without discount. All invoices that are not paid within 30 days will be increased with a fixed penalty equal to 15% of the amount of the invoice, with a minimum of 37.18 euros (1,500 BEF), and will automatically and without prior formal notice give rise to an interest at the rate of 1% per month commenced. Any amount under 12.39 euros (500 BEF) will be invoiced at 12.39 euros (500 BEF) + VAT
.

9. Forwarding charges payable by the Consignee will be invoiced to the Sender after 30 days if the Consignee failed to meet his obligations.

10. Any dispute will give rise to the initiation of formal proceedings with the Courts of Brussels.
